Pero ngayon, BUONG KORTE SUPREMA na ang
BINABASTOS at BINABALE-WALA, nina Hacienda Luisita Inc (HLI) lawyer Antonio Ligon at Department of Agrarian
Reform (DAR) Sec. Virgilio delos Reyes.
As we all know by now, the SC has pegged
the value of Luisita at P40,000 per hectare as basis for the compensation the
owners should get, or close to P200 million for the 4,915.75-hectare hacienda.
But The Philippine Star reported that Ligon
says ONLY THE DAR and the LAND BANK OF THE PHILIPPINES (LBP) could come up with
the exact figure for the compensation.
Meaning, for Ligon, the DAR and the LBP
are HIGHER than the SC.
The SC is the FINAL INTERPRETER of the
law. I’m not a lawyer but I’m aware of
the fact that every lawyer knows this, and can never dispute this.
Kaya walang ibang puiwedeng maging
kahulugan ang sinabi ni Ligon kundi LANTARANG PAMBABASTOS sa Korte Suprema. If
Ligon will say he’s not being rude or disrespectful to the SC, then he’s a
STUPID LAWYER.
But this, he’ll surely deny to high
heavens.
Ligon even tried to make the HLI owners look
magnanimous in defeat and deeply law-abiding people by saying, in a statement: “We will not challenge the ruling. No
pleading will be filed.”
Of course they won’t, because they know
it will be USELESS.
The SC decision CATEGORICALLY stated
that NO MORE PLEADINGS on the case will be entertained by the tribunal. Even a high school kid will readily understand
the meaning of these words.

Unless Ligon doesn’t mind looking like
an IDIOT just to earn ‘pogi points’ from his clients.
For his part, Delos Reyes said the DAR
will have to inspect Luisita before doing a valuation of the property. Again,
this despite the P40,000 set by the SC for every hectare.
A million to one, the DAR, or any other
government agency for that matter, DOES NOT HAVE THE POWER to amend or review
any SC DECISION.
This is ARROGANCE and RUDENESS of the
highest order!
Delos Reyes said the LBP will determine
the INITIAL valuation for Luisita based on conditions set by the SC and
existing applicable
guidelines.
COMMON SENSE will dictate that the SC
arrived at P40,000 per hectare based not only on existing guidelines but also
THE LAW.
It would be IDIOTIC for anyone to think
or insinuate that the P40,000 was, or may have been, simply what the SC had
felt like tagging on Luisita.
Bottom Line: The DISRESPECT of Pnoy’s
Administration of the SC is getting more and more UNDENIABLE!
When the Executive branch of government
does not respect the Judiciary, that means the LAW SHJOULD BE WHAT THEY WANT,
not what it is.
That would be a DICTATORSHIP! That’s the danger we’re
facing!
