BANALS ADMISSION FULL OF HOLES!

There are a LOT OF HOLES in the admission of Quezon City Rep. Jorge Banal that he had visited PSBank Katipunan branch manager and Corona impeachment trial prosecution witness Annabelle Tiongson.

Banal said he did not notify his colleagues of his visit because he did not want to add to the strain they were already experiencing.

His colleagues in the prosecution have been TIRELESSLY giving press briefings every day of the trial and in appearing in or grating interviews in every TV and radio show possible to ventilate their case.

What strain is he talking about?

If he’s not lying, will Banal concede that he was STUPID enough not to realize the importance of the bank record to his colleagues in the prosecution?  I’ll bet a thousand to one, guys, he won’t.

Banal told media people “District ko kasi yung bank, medyo nagba-baka-sakal ako.” Nagbabaka-sakali saan o para ano (Taking a chance at what)?

He’s not a prosecutor. Neither is he the one who calls the shots in the prosecution. The prosecution’s boss is lead prosecutor Rep. Niel Tupas Jr. So there’s NO LOGICAL REASON why he should conceal his visit to Tiongson.

Prosecution spokesman Miro Quimbo told reporters “many of us did not know of the document.” Take note, people, just MANY, NOT ALL OF THEM in the prosecution.

So if Quimbo is telling the truth, OTHER PEOPLE in the prosecution KNEW of the document in Banal’s possession. Why was Banal SELECTIVE in revealing what he had?

Banal said he discovered the folded, one-page photocopy of the bank record in his driveway. But he did not say when and how, and what did he initially do, considering what the document was.

Being a congressman, surely he had bodyguards, and maids or houseboys. He did not say how come these people didn’t see it first.

Besides, why does it have to be him to whom the document would be entrusted to? Why not the prosecution spokesmen or the prosecutors themselves?

Banal said he went to the bank the next day to ask about the document. But HE DID NOT LEAVE the document with Tiongson. Quimbo said what Banal left was his business card.

Obviously, Banal REALIZED THE IMPORTANCE of the document. Otherwise, he WOULD HAVE LEFT it if he had deemed it as just another ordinary leaked document with no value to him or his colleagues.

So again, WHY did he have to conceal it?

Well, just subpoena the bank's records. The bank is liable no matter what, whether it is fake or not. Someone paid the bank to lie or perhaps to provide prosecutors a copy with no signature. Is there a videocam in ever nook and wall of the bank? I smell a rat.. you can not call a copy of the bank fake especially if the document is a duplicate. Only the signature is missing. That is not a fake document.

Well, if there are signatures on the original and there aren't signatures on the copy, then it's not a true copy at all. How can a photocopy machine not copy something that was there to begin with? And how about the bank president saying that they have a SIMILAR form, but not the exact same form? How can they have a "copy" of a form that doesn't exist? In the words of the prosecution's own witness, the form is a fake.

Unless of course, teleserye sa ABS-CBN pala ang pinapanood nila at hindi ang impeachment trial. I used to admire Sen Drilon pero simula noong kinasuhan niya si Sen. Enrile ng kasong Rebellion with Complex Murder, para lamang mapagbigyan ang Pangulo na humirang sa kanya bilang Justice Secretary, nawala ang paggalang ko sa kanya. Imagine, Justice Secretary ka tapos ang kasong isasampa mo sa isang tao ay isang kasong galing sa iyong guni-guni.

Why can't you people understand what the senator was doing? He was merely trying to find out the truth and with what the prosecution has been doing, there is no chance of finding out what really is the truth. If the CJ has got nothing to hide, then he has nothing to be afraid of if the senators are asking questions. Beside, as judge, the senators can propound questions on any matter involved in the impeachment case.

PSBANK MANAGER SAYS CORONA RECORDS FAKE!

The prosecution in the impeachment trial of Chief Justice Renato Corona had better have an AIRTIGHT EXPLANATION on TWO DAMINING REVELATIONS which BELIE their grounds in requesting for a subpoena for his PSBank records.

Otherwise, ALL THE EVIDENCE which had been submitted by the prosecution from the start should first be EXAMINED for both AUTHENTICITY and the LEGALTY of how these were acquired.

Before the trial continues, and the prosecution DELAYS the it again with DENIALS of their stories and/or evidence by their OWN WITNESSES or physical proof.

For those who missed it, PSBank Katipunan branch manager Annabelle Tiongson testified in today’s hearing that the prosecution’s copies of Corona’s supposed deposits in her branch were "fake documents.”

Tiongson categorically stated that the documents “did not come from our bank. They are not replicas of genuine documents."  She said PSBank records are generated by the bank’s computers and have bar codes printed on the pages.

Remember, people, the subpoena issued to PSBank for the records of Corona’s peso and dollar deposits were BASED on the prosecution’s supposed copies of the documents.

And that subpoena almost led to a CONFRONTATION the Senate and the Supreme Court, following the issuance by the High Tribunal of a temporary restraining against it.

So the prosecution must prove, IMMEDIATELY, that it had not done anything illegal following Tiongson’s testimony.

Mindoro Rep. Reynaldo Umali earlier claimed before the Senate impeachment court that a small lady handed over to him Corona's PSBank records outside the Senate building last week.

But Senate Majority Floor Leader Vicente Sotto III said a report by the Senate sergeant-at-arms noted that closed-circuit television (CCTV) recordings do not show any little ladies giving anything to Rep. Umali, from the time he arrived at one o’clock up to the time that he boarded his vehicle.

So now, it’s the prosecution’s word against Tiongson’s, who ironically is their own witness.

TAKE NOTE people, Tiongson is a more AUTHORITATIVE and COMPETENT position to speak on the authenticity of her branch’s records than ANYONE among the prosecutors.

As to Umali’s ‘small lady’ claim, the prosecution would have to prove a MAJOR MALFUNCTION or monitoring lapse in the Senate’s CCTV to prove his story.

If they try this alibi, they had better do a rock-solid one since the Senate can call in the best experts anytime to evaluate whatever explanation they’ll give.

Otherwise, video doesn’t lie. I can’t think of any other way for Umali’s story to stand up to Senate, and public, scrutiny. 30

TAKUTAN NA ANG LABAN sa Corona  impeachment!

Following the Supreme Court’s temporary restraining order (TRO) against the subpoena to PS Bank for the supposed dollar accounts of Corona, prosecutor Ilocos Norte Rep. Rudy Farinas said he will file an impeachment complaint against the justices who voted for the TRO.

Prosecution spokesman Marikina Rep. Miro Quimbo said they would support the move of Farinas. Commenting on the possibility of a constitutional crisis, Quimbo arrogantly added “The Supreme Court brought it upon themselves.”

NO CLARIFICATIONS, NO DIALOGUES, nothing whatsoever.

Instead of first exploring all possible remedies, Farinas and Quimbo would rather do another Corona. As if they’re telling the justices who voted against the subpoena “Allow the subpoena or prepare for trouble.”

It seems Farinas and Quimbo don’t take ‘no’ for an answer whenever they want something.

Their declarations would have been alright if Farinas and Quimbo are acknowledged top guns when it comes to law who can spar anytime with any justice of the Supreme Court.

But as far as I know, they’re not.  Anybody correct me if I’m wrong.

I remember Farinas being in the top 10 when he passed the bar exams. But again, I don’t recall him having spent a good number of years as a judge recognized for his intellect and wisdom.

Again, anybody correct me if I’m wrong.

So think hard, ladies and gentlemen: If Farinas and Quimbo can think and act like this towards nothing less than Supreme Court justices, what more with ordinary mortals like us who’ll piss them off?

I’m not saying that the Supreme Court was correct in issuing the TRO. Neither am I saying that it would be wrong for Farinas and Quimbo to file an impeachment complaint against the justices.

What I’m driving at is everybody should STAY CALM and resolve differences as PEACEFULLY and as quickly as possible.

The Corona impeachment trial is already EATING UP a whole damned lot of the precious time of the Senate and of the congressmen-prosecutors.

But except for those who are after the hours-long media exposure, NOBODY has been winning. IT’S US, the people, who have been LOSING THE BIGGEST, with millions of our taxes being spent on the trial’s needs.

And we will lose MILLIONS MORE if we won’t shout in one earth-shaking and UNITED voice, that the politics and politicking in the Corona trial are MORE THAN ENOUGH for us.

The choice is ours, people

How about the delaying tactics of the defense and their effort to suppress the evidence and the truth? If Corona is really clean, he had nothing to hide. So why suppress the evidence?

A CHALLENGE TO BIR'S FAIRNESS!

Here’s a simple challenge to the fairness of Bureau of Internal Revenue (BIR) Commissioner Kim Henares: Probe the finances of Corona trial lead prosecutor Rep. Niel Tupas in connection with his multi-million lot in Xavierville 1 Subdivision, Quezon City.

Henares had admitted in the impeachment trial that the BIR launched an investigation into Chief Justice Renato Corona following revelations of alleged questionable figures in his finances, even without a formal complaint before her office.

If it can be done to Corona immediately, there’s no reason why it can’t be done to Tupas. If Henares won’t investigate the congressman, she had better have an airtight justification.

Otherwise, it will be nothing less than SELECTIVE and UNFAIR implementation of BIR rules.

Just like Corona’s supposed finances, issues on Tupas’ Xavierville lot are now out in media, like the cost and doubts by the Quezon City Assessor’s Office.

Tupas spends TAXPAYERS’ MONEY, our money, in performing his functions as a congressman. The people have the right to know, immediately, if these monies are being spent properly, and legally.

Especially if there is a questionable issue against Tupas, like his capability to buy a P14-million lot on his P25,000 monthly salary as a congressman.

Anybody correct me if I’m wrong but there is no publicly known multi-million peso business of Tupas or his wife which is earning enough for them to afford the Xavierville property.

For those who missed my preceding blog, the Quezon City Assessor’s Office has categorically stated that the zonal valuation of the land in Xavierville 1is P20,000 per square meter.

The current going rate is P40,000 per square meter.

So the lot being 630 plus square meters, the price is from a low of P12 million plus at the zonal valuation of P20,000 to as high as P25 million at the current going rate of P40,000.

And that is only for the lot, people.

I consulted another wealthy businessman as I was writing this blog. He said a modest mansion nowadays would cost at least P30 million, not P15 million as I had written in my preceding blog.

So that puts the house and lot at a minimum of P40 million. Question: Is Tupas that rich?

TUPAS' TURN TO PROVE HE'S CLEAN!

It’s now the turn of impeachment trial lead prosecutor Rep. Niel Tupas Jr. to prove that he got rich LEGALLY.

Tupas admitted owning a house in Xaviervilla Subdivision, one of the most expensive villages in Quezon City. He said the structure costs P14 million and not P50 million as reported.

But  Tupas DID NOT SPECIFY if the P14 million was the cost of the house only or for the house and lot. A licensed Quezon City-based real estate businessman informed me that THERE IS NO WAY that P14 million will be enough for a house and lot in Xaverville.

Surely, the lot was NOT FREE. And if it is indeed free, Tupas will have a whole damned lot to explain.

As a congressman, Tupas only earns P25,000 a month. Therefore, he has to EXPLAIN where did he get the money for the house.

It’s now Tupas’ turn to make public his statement of assets, liabilities and net worth (SALN) and all the other proofs of his income and monies, including his bank deposits.

FOR SCRUTINY by the public.

Tupas boasted to reporters that he could pay for the house even without a loan. That means he has a lot more than P14 million. So he should reveal where he gets his money, and prove that it’s LEGAL and CLEAN.

The people have a right to know.  

Tupas DID NOT CITE any source of income in his press statement in the Philippine Star.

If he has nothing to hide, there should be no problem for Tupas to IMMEDIATELY release all these details to media. Unless he can show proof, 

Tupas is NOT EXEMPT under any circumstance from immediate public disclosure of his SALN.

Neither should he use his preoccupation with the Corona impeachment trial as an excuse to defer disclosure of his SALN. His staff can prepare his SALN for him.

If he can’t make a public disclosure personally, his staff can do it for him.

All these, of course, on the assumption that Tupas knows the meaning of TRANSPARENCY and FAIR PLAY.
